1106.1 (A) The Group Must Be Limited to Unpublished Works
An applicant cannot use this option to register a group of published and unpublished works. If any of the works have been published, the applicant should not include those works in the claim. The applicant is responsible for determining if the works are unpublished, and generally, the U.S. Copyright Office will accept that determination unless it is contradicted by the information contained within the registration materials.
